Terms of Service

These Terms govern use of the current Postvertise product: accounts, profiles, social connections, creator discovery, and campaign workflows. Features that are not implemented (such as payments) are called out explicitly.

This document is provided for informational purposes and is subject to final legal review. It does not constitute legal advice.

1. Acceptance of Terms

These Terms of Service ("Terms") govern access to and use of the Postvertise Platform operated under the RightBack.com LLC d/b/a Postvertise brand ("Postvertise," "we," "us," or "our").

By creating an account or using the Platform, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Platform.

These Terms describe features that exist in the current product. Marketing pages may describe future ideas; unimplemented features are not obligations.

2. Eligibility

You must be at least 18 years old (or older if required where you live) and able to form a binding contract.

If you use the Platform for an organization, you represent that you have authority to bind that organization.

3. Accounts

You must choose an account type: Creator or Brand. You must provide accurate registration information (including email and profile identifiers required for your account type).

You may maintain one account unless we authorize otherwise. You are responsible for activity under your account.

4. Account Security

Primary sign-in uses a passwordless email magic link. Keep access to your email secure. Where a password exists for an account, you must keep it confidential.

Notify us promptly using the contact details in Section 27 if you suspect unauthorized access.

We may suspend accounts to protect the Platform or other users.

5. Creator Accounts

Creators may create profiles, connect supported social accounts, view synced analytics for their connections, browse opportunities, and participate in campaigns.

You must have the right to connect each social account and to display the information you publish on your profile.

6. Brand Accounts

Brands may create brand profiles, discover Creators, and create/manage campaigns, invitations, applications, participants, deliverables, and submission reviews.

You represent that you are authorized to act for the business associated with the Brand account.

7. Marketplace

Postvertise provides tools for discovery and campaign coordination between Creators and Brands.

Unless a separate written agreement says otherwise, Postvertise is not a party to commercial contracts between users and does not guarantee campaign outcomes.

Users are responsible for advertising disclosure and other legal obligations applicable to their promotions.

8. Campaigns

Brands may create campaigns with descriptions, budgets, schedules, platform targets, audience targeting metadata, and deliverable definitions.

Campaign statuses and management actions available in the product (such as activate, pause, resume, complete, cancel, or delete) are controlled by the Brand according to Platform rules and authorization checks.

9. Applications and Invitations

Brands may invite Creators; Creators may apply to opportunities where enabled.

Invitation and application messages and status changes are visible to the relevant counterparties.

Accepting an invitation or application may create a participant relationship and deliverable tasks.

10. Deliverables and Content Submissions

Participants may receive deliverable tasks and submit content references (such as URLs), captions, and notes for Brand review.

Brands may approve submissions or request revisions using Platform tools.

Submitting materials on Postvertise does not, by itself, publish those materials to Instagram, Facebook, TikTok, or X. Social publishing is not implemented.

11. User Content

"User Content" means content you submit or publish on the Platform, including profile text/images and campaign-related text/URLs.

You retain ownership of your User Content. You grant Postvertise a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display User Content as needed to operate the Platform.

You represent that you have rights to the User Content you submit and that it does not violate law or third-party rights.

12. Content Rights and Licenses

The license in Section 11 is limited to operating, securing, and improving the Platform and fulfilling our agreements with you.

It does not give Postvertise ownership of your social-platform accounts or of content that remains solely on third-party platforms.

13. Prohibited Behavior

You agree not to:

  • Use the Platform unlawfully or fraudulently
  • Impersonate others or misrepresent affiliation
  • Attempt unauthorized access, interfere with security, or abuse rate limits
  • Scrape or harvest data except through documented Platform features you are permitted to use
  • Harass other users
  • Connect social accounts you do not own or control
  • Upload malware or infringe intellectual property or privacy rights

14. Social Integrations

Creators may connect Instagram, Facebook, TikTok, and X when those integrations are enabled for the environment.

By connecting, you authorize Postvertise to access and store the categories of information described in the provider consent screen, our Privacy Policy, and Social Data Disclosure.

You may disconnect integrations in the product; disconnection deletes stored credentials and synced data for that connection.

15. Third-Party Platforms

Social platforms are independent. Postvertise is not affiliated with, sponsored by, or endorsed by Meta, TikTok, X Corp., or related companies unless we expressly say so in writing.

Your use of those platforms remains governed by their terms. API changes may affect Postvertise features.

16. API Integrations

Social features depend on third-party APIs and the scopes currently configured in Postvertise. We only request scopes required for implemented functionality.

We do not guarantee uninterrupted API access.

17. Platform Independence Disclaimer

Postvertise operates independently from social networks. Connection to a network does not create a partnership or joint venture with that network.

18. Payments, Fees, Cancellations, and Refunds

Payment processing, escrow, payouts, subscription billing, cancellations, and refunds are not implemented on the Platform at this time.

Campaign budget fields store planning information for users; they do not charge cards or move funds through Postvertise.

If payment features are introduced later, additional terms will be presented before use.

19. Intellectual Property

The Platform's software, design, and Postvertise branding are owned by Postvertise or its licensors.

Except for limited rights needed to use the Platform, no IP license is granted to you.

20. Suspension and Termination

You may stop using the Platform at any time. Authenticated users may delete their account from Dashboard → Settings. Offline deletion requests are described on Data Deletion.

We may suspend or terminate access for Terms violations, risk to users/platforms, or legal requirements.

21. Deletion

Social-account disconnection deletes that connection's stored tokens and synced social data from Postvertise.

Authenticated users may delete their Postvertise account from Dashboard → Settings (DELETE /api/account for the signed-in owner). Deletion removes or anonymizes personal account data, disconnects social accounts, and ends authenticated access. Shared campaign relationship rows may remain in anonymized form where required for referential integrity. Provider-side OAuth revocation is not currently implemented. See Data Deletion.

22. Disclaimers

The Platform is provided "as is" and "as available" to the fullest extent permitted by law.

We do not guarantee uninterrupted service, accuracy of user-provided or third-party API data, or outcomes of Creator–Brand relationships.

23. Limitation of Liability

To the fullest extent permitted by law, Postvertise will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill arising from use of the Platform.

To the fullest extent permitted by law, Postvertise's aggregate liability for claims relating to the Platform will not exceed one hundred U.S. dollars (USD $100), except where such limitation is prohibited by law. Because paid Platform fees are not collected in the current product, a “fees paid in the prior twelve months” cap is not applicable at this time.

24. Indemnification

You will defend and indemnify Postvertise and its personnel against claims arising from your User Content, your misuse of the Platform, your social-account connections, or your violation of these Terms or third-party rights, to the extent permitted by law.

25. Governing Law and Disputes

Governing law and exclusive venue are not specified in these Terms. The business address location does not by itself select a contractual governing law or venue. Until the operator or legal counsel provides governing law and venue terms, disputes remain subject to applicable law without a contractual venue selection here.

Before formal proceedings, contact us using Section 27 and attempt an informal resolution.

26. Changes to Terms

We may update these Terms by posting a revised version and updating the “Last updated” date.

If you do not agree to updated Terms, stop using the Platform.
